PHOTO SESSIONS TERM & CONDITIONS

By booking and attending an appointment you are agreeing to the following:

CELL PHONE CAMERAS & OTHER RECORDING DEVICES MAY NOT BE USED DURING OUR SESSION.

1.    SOCIAL MEDIA POLICY
You are free to share any of your final photos on any social media platforms. The client will not edit/alter/apply filters to the photos. Giving credit to Photography By Tina Sawicki when posting on social media is appreciated.

2.    Retainer and Payment.
The Client shall pay a deposit in the amount of 50% minimum for photo sessions and full payment is required prior to Pop-Up sessions (Pop-Up Sessions will vary on price depending on location and theme), to the Photographer to perform the services specified herein. The client shall pay the deposit upon booking a session. This deposit is payable via cash or email money transfer to tsaw@arttina.com (auto-deposit). The balance of the session fee is due the day of the photoshoot.

If additional time is required outside of the photographers discretion, (providing the photographer has the space required), over time will be charged at $75 + tx per additional 30 minutes

3.    Cancellation.
If Client shall cancel less than 24 hours your deposit will not be refunded and is not be transferable to another session. A minimum of 48 hours is required for cancellation. Over 48 hours, the deposit can be transferred to a new booking. No refunds are issued. Deposit must be used within 6 months of cancelling or postponing your session.

If the client is more then 15 minutes late and has made no contact to the photographer (email, text or phone call), the session will be considered canceled and the deposit will not be refunded.

Due to the locations typically being outdoors, they rely on weather. If weather is cause for cancellation, a session will be rebooked at no additional charge from original fee.

4.    Copyright and Reproductions.
The Photographer shall own the copyright in all images created and shall have the exclusive right to make reproductions. The Photographer shall only make reproductions for the Client or for the Photographer’s portfolio, samples, self-promotions, entry in photographic contests or art exhibitions, editorial use, or for display within or on the outside of the Photographer’s studio. Otherwise a Non-Disclosure Fee of $150 shall apply. If the Photographer desires to make other uses, the Photographer shall not do so without first obtaining the written permission of the Client.

Photographer retains the original copyright in all images created. The Client shall not resize or reuse said photos for advertisements, sales or promotion of any kind unless permission has been received from Photographer. Permission will be granted in most situations, although a fee may be necessary in some. Copyright can be purchased outright for an individual photo at $150.

As an artist, I reserve the right to artistically interpret what I see and in what ways I choose to photograph a scene. This may mean that some shots are colour, some are B&W. Images presented to the client are the only images available. No original, unedited photos will be available.

5.    Client’s Usage.
The Client is obtaining prints and / or digital files for personal use only, and shall not sell said prints or digital files or authorize any reproductions thereof by parties other than the Photographer. Copyright is not automatically transferred with basic photography session fees and is a separate transaction.

6.    Failure to Perform.
If the Photographer cannot perform this Agreement due to a fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to the Photographer’s illness, then the Photographer shall return the deposit to the Client but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or computer malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client’s order.

If I, the photographer, am not satisfied with the results of the session, another will be rescheduled at no additional cost as long as session conditions have not changed.

There is no guarantee of the number of images presented from a session. Many factors contribute to this, including the cooperativeness of the subject.

7.    Liabilities.
Client will be responsible and assumes the risk of all damages or injuries to their pet(s), themselves and participants in the session including any interaction between pets participating, all destruction of personal, business or public property, or personal injury before proceeding, during and immediately following a session, specifically including the risks associated with on-location sessions.

Any breakage or damage to the Photographer’s equipment due to your pet's misbehaviour or actions is the sole financial responsibility of the client to replace equipment. Know your pet’s behaviour and limitations before bringing them to any public area. Photographer will take every precaution to protect said equipment in all instances. Please disclose any behavioural or aggression issues before your session. Photographer has the right to refuse session based on these issues.

8.    Pet Control.
Client understands that at all times their pet must be leashed and under Client’s full control. Client agrees to be solely responsible for any and all acts or behaviour of their pet while in photo session. Should Client’s pet become frightened, agitated, or aggressive, Client understands that they must take immediate action to gain control over their pet and to remove their pet from the situation.

Client further understands that Photographer reserves the right to physically remove pet from any situation where a disturbance is created where the pet appears dominant or aggressive or that is deemed to be dangerous or undesirable to Client’s pet or any other pet(s) or person, and that in any such situation we may be asked to leave the session without refund of any monies paid.

9.    Health Conditions.
Client hereby certifies that to their best of their knowledge their pet is in good health and has not been ill with any known contagious diseases and has been fully vaccinated for bordetella (commonly known as "kennel cough"), rabies, distemper and parvo. Client agrees that if immediate or emergency care is needed and provided Client shall be solely responsible for the cost of any and all such care of their pet.

10. Possible Exposures.
Client is aware that their pet may be exposed to infectious diseases as listed above. However, since Photographer has advised Client that their pet should be fully vaccinated against those diseases before attending session Client is responsibility for any such exposure. Client also acknowledges that in addition to the diseases described above their pet may be exposed to other infectious diseases. However, in order for Client’s pet to participate in photo session activities, Client alone assumes the responsibility of such exposure to all other infectious canine diseases.
